Florida Airplane Accidents:

Airline crashes typically result in the most traumatic injuries and death. These cases are extremely complex and may involve federal, state, or international laws and treaties. Florida Vehicle Accidents:

Legal claims that arise from vehicle accidents are typically governed by the law of negligence. Any individual who negligently operates a motor vehicle may be required to pay damages to an injured victim. Additional monetary compensation may be provided if an injured employee is temporarily unable to work for more than a certain number of calendar days set by state law, hospitalized as an in-patient, or becomes permanently disabled due to a job-related injury or illness. The right to receive medical treatment at the employer's expense typically continues as long as treatment is reasonable and necessary to treat the injury.

Florida Toxic Exposure:

Due to the tremendous growth of corporate industry in the United States over the past fifty years, the number of dangerous, toxic substances in the environment has grown significantly. Some toxic substances are shown to cause substantial injury to people, such as lead-based paint as linked to brain damage, especially in children. Asbestos has been proven to cause lung cancer and restrictive lung disease. Dry cleaning and other solvents have been linked to brain damage and major organ damage. Pesticides such as dioxin and DDT have caused birth injuries and toxic landfill waste has been linked to leukemia. Typically these injuries occur from either working with toxic chemicals or living near a facility that manufactures or uses dangerous chemicals. There can also be exposure at playgrounds or in drinking water.

Traumatic Brain Injury:

Traumatic brain injury (TBI) is a medical phrase used to describe the damage to the brain suffered by sudden impact or physical force to the head. Essentially, the human brain floats in a fluid substance call cerebrospinal fluid. TBI can result when an impact causes the momentum of the brain to come into contact with the skull. This type of injury, often the result of hitting your head on the windshield, pavement, or object, is frequently referred to as a "closed head injury." Whiplash can also cause TBI. These closed head injuries can result in lasting physical and mental problems.

Florida Defective Products:

Product liability refers to a manufacturer or seller being held liable for placing a defective product into the hands of a consumer. A person injured by a defective or dangerous product may be eligible to file a lawsuit for product liability, and recover damages under one of the following categories: strict product liability, negligence, or breach of warranty.

Florida Slip And Fall/Premise Liability:

Slip and fall accidents can cause serious injury, although often are not taken seriously. A fall on another person's property due to unsafe conditions may be eligible for compensation due to personal injury. Property owners are responsible for keeping their premises safe and must warn visitors of potential non-obvious hazards. In Florida, Section 767.04 of our State Statutes creates strict liability for owners of dogs. Dog owners in Florida have statutory responsibilities to ensure that their pets do not harm others. A dog bite victim may be entitled to compensation from a party whose negligence caused the attack, a party who violated a public health and safety law, such as a leash law, and/or from a party who kept a dog with the knowledge that the dog had a history of injuring people.

Florida Wrongful Death:

Wrongful death can result from the negligence of others from any of the accidents described above. Losing a loved one is extremely difficult situation, both financially and emotionally. Florida has a specific statutory scheme called the "Florida Wrongful Death Act" which controls these cases and there are very specific timing and legal requirements to file claims under the Act. Typically, these cases must be filed within two (2) years of the date of death, although it may be earlier or later depending on the nature of the claim.
